The Grand Jury

 

Facts

 

Created to be the citizen's authority to investigate malfeasance (misconduct on the part of public officials) as well as other duties.  Criminal cases are to be turned over to the DA for further investigation and prosecution.

 

 

 

The current world

 

In many places the Grand Jury is under the control of the DA's office so any complaints about police/DA get quashed by the DA in all but the few cases where public and/or political pressure gets to the point where they cannot ignore it.

 

After having received and assigned a case number to an official report of criminal activity engaged in by Sheriff and DA more than a year previous, the San Diego County Grand Jury called and wrote a letter refusing to deal with the issues of criminal activity.

 

We were informed that the San Diego Grand Jury only handles civil events and they had no idea where or if a similar organization was in existence to handle criminal complaints involving public officials.

 

This totally shatters the concept of the Grand Jury and sets us back on our heels a bit.  Further, if you refer to the CA Attorney General's letter page 1 and letter page 2 responding to Mitchell's complaint, it is seen in item #7 that the Attorney General specifically states that a report to the Grand Jury is a requirement as part of efforts for a local resolution.
